Daniel Penny still faces count of criminally negligent homicide

The New York City judge in the Daniel Penny subway chokehold trial agreed to drop the top manslaughter count after the jury deadlocked twice. The 12-person panel had been instructed by the judge that they first needed to reach a verdict on the top count before they could consider the lesser count of criminally negligent homicide.
